Terms of Service

These terms cover every service of Dumm Software LLC (“we”): SMSWeather, Wingbeat hosted plans, the Kodiak Orthoimagery Mosaic, custom software work, and our websites (dummthings.dev and its subdomains). By signing up for or using any of them, you agree to these terms. The general terms below apply to all of them, and each service’s section adds terms for that service. Where a service’s section differs from the general terms, the section wins for that service.

General terms

  1. Payment. Payments are processed by Stripe. Subscriptions are billed monthly in advance and renew until you cancel. Custom work is invoiced as set out in its quote, and invoices are due within 30 days unless the quote says otherwise. Prices are in US dollars and don’t include any taxes that apply.
  2. Cancellation and refunds. Cancel a subscription any time by emailing will@dummthings.dev. Service continues to the end of the period you’ve paid for, and we don’t charge you again. If you cancel within 14 days of your first payment, we’ll refund it in full. After that we don’t refund partial months, except where the service was unavailable for a significant part of the month through our fault. Refunds go back to the original payment method, usually within 10 business days.
  3. Privacy. Our Privacy Policy explains what information we collect and how we use it, and is part of these terms. Mobile information and opt-in data are not shared with third parties for marketing or promotional purposes.
  4. No guarantee. Our services are provided “as is”, without warranties of any kind. There is no guarantee that the data they provide (forecasts, flight tracking, imagery or anything else) is correct, complete or timely, or that a reply, notification or map tile will arrive. Do not rely on them for safety-critical decisions. If you choose to use them, you accept that it is at your own risk.
  5. Changes to the services. We may change, suspend or stop any part of any service at any time, without notice.
  6. Acceptable use. Use our services only for lawful purposes. Don’t try to disrupt them or the systems they run on, send them automated or bulk requests beyond normal use, or resell them.
  7. Ownership. The SMSWeather and Wingbeat names, our websites and our software belong to Dumm Software LLC, except code we publish under an open source licence, which you can use under that licence. Forecasts come from NOAA and other public sources, and imagery from USGS. We give you a personal, non-exclusive, non-transferable licence to use our services under these terms, which we can withdraw at any time.
  8. Ending your access. We may suspend or end your access to any service at any time and for any reason, for example if you break these terms. You can stop using a service at any time.
  9. Limitation of liability. To the fullest extent the law allows, Dumm Software LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss resulting from your use of a service, from relying on it, or from its being unavailable. Our total liability for any claim relating to a service is limited to the greater of $10 and the amount you paid us for that service in the 12 months before the claim arose.
  10. Indemnification. You agree to cover any claims, losses and costs (including reasonable lawyers’ fees) that Dumm Software LLC faces because of your use of our services or your breaking these terms.
  11. Other websites. Our sites and messages may link to websites we don’t run, such as NOAA’s. We aren’t responsible for their content or practices.
  12. Governing law. These terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law rules. Any dispute relating to them or to our services will be decided by the state or federal courts located in Washington.
  13. Changes to these terms. We may update these terms. We will post the new version on this page with a new effective date, and email signed-up users and customers about any material change. Changes take effect when they are posted, and using a service after that means you accept them.

SMSWeather

Program name: SMSWeather · Operator: Dumm Software LLC · Support: will@dummthings.dev, or text HELP to the service number.

  1. The program. SMSWeather is a service of Dumm Software LLC that provides weather forecasts by text message (SMS): NOAA point and marine zone forecasts, aviation TAFs and METARs, and fisheries announcements. SMSWeather does not charge for the service. To use it, fill out the sign-up form and consent to receive forecasts. You will be emailed the service phone number, then text that number to request a forecast. SMSWeather replies immediately and directly to your request. It does not send marketing or promotional messages. Apart from the replies to your requests, the only other texts it sends are the replies to the keywords HELP, INFO, STOP and START.
  2. Message frequency. Message frequency depends on how often you text us. You will receive 1-10 text messages in reply to each request you send. SMSWeather only replies to your texts and never sends unsolicited messages.
  3. Message and data rates. Message and data rates may apply for messages you send to us and receive from us, according to your mobile plan. If you have questions about your text plan or data plan, contact your wireless provider.
  4. How to opt out. Text “STOP” or “UNSUBSCRIBE” to the service phone number at any time. We will send you a text confirming that you have been unsubscribed, and after that you will not receive any more messages from us. You can also stop simply by not texting the number. To join again, text “START” to the service number.
  5. Help. Text “HELP” or “INFO” to the service number for instructions, or email will@dummthings.dev.
  6. Carriers. Carriers are not liable for delayed or undelivered messages.
  7. Contributions. Contributions to SMSWeather’s costs are voluntary and don’t change the service you get. Monthly contributions can be changed or cancelled at any time, and one-time contributions are refunded on request within 14 days.

Wingbeat

  1. Hosted plans. Wingbeat hosted plans log flights from Garmin inReach MapShare feeds, send the notifications you set up, and keep maintenance and duty records, billed monthly at the price shown on the Wingbeat site when you sign up.
  2. Your Garmin account. Your inReach device and its Garmin subscription are separate from Wingbeat and are between you and Garmin. Wingbeat can only log what your MapShare feed reports.
  3. Records. Wingbeat’s maintenance and duty records are a convenience, not your official records. You remain responsible for your aircraft’s airworthiness and for meeting any regulatory recordkeeping requirements.
  4. Self-hosting. If you run Wingbeat yourself from its source code, its open source licence applies to the code and these terms don’t apply to your copy.

Kodiak Orthoimagery Mosaic

The Kodiak Orthoimagery Mosaic is public-domain USGS imagery that we prepare and host for free. Use it in any project, but keep the attribution, and don’t use it in a way that overloads the service. We may rate-limit, change or stop it at any time.

Custom software

Custom software and map layer work (design, development, hosting and support) is priced per project in a written quote. A signed agreement or written quote for a project takes precedence over these terms where they differ. If either of us ends a project early, you pay for the work done up to that point, and we refund any prepaid amount for work not yet done.
